Terms and Conditions for DocX.lk

Welcome to DocX.lk. These Terms and Conditions govern your access to and use of the DocX.lk website, mobile applications, and online video consultation services. By registering an account or using our platform, you agree to be bound by these terms.

1. Nature of the Service

DocX.lk operates as a digital healthcare platform facilitating online video consultations between patients and registered medical practitioners.

  • Not for Emergencies: DocX.lk is not designed or intended for use in medical emergencies. If you are experiencing a life-threatening situation, severe pain, trauma, or acute symptoms, you must immediately visit the nearest hospital or casualty ward.
  • Facilitator Role: DocX.lk acts solely as a technology intermediary connecting you with independent healthcare professionals. We do not directly provide medical, diagnostic, or treatment services. The doctor-patient relationship is exclusively between you and the consulting practitioner.

2. User Accounts and Responsibilities

  • Eligibility: You must be at least 18 years old to create an account. Minors may only use the platform under the direct supervision of a parent or legal guardian who holds the registered account.
  • Accuracy of Information: You are required to provide accurate, current, and complete medical history and personal information. The consulting medical professionals rely on this information to provide appropriate medical advice.
  • Account Security: You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.

3. Consultation Guidelines

  • Limitations of Telemedicine: You acknowledge that online video consultations have inherent limitations compared to in-person physical examinations. Practitioners may not be able to diagnose certain conditions via video and may advise an in-person clinical visit.
  • Prescriptions: The issuance of prescriptions is entirely at the professional discretion of the consulting doctor based on their assessment. Certain medications, including controlled substances, cannot be prescribed via teleconsultation.
  • Connectivity: A stable internet connection is required for seamless video consultations. DocX.lk is not liable for dropped calls or poor video quality stemming from user-end hardware or network issues.

4. Payments, Cancellations, and Refunds

  • Fees: All consultation fees must be paid in full prior to the commencement of the video session via our approved payment gateways.
  • Cancellations by User: Appointments cancelled at least 24 hours prior to the scheduled time are eligible for a full refund. Cancellations made within 24 hours of the appointment time may be subject to a cancellation fee.
  • Missed Appointments: If you fail to log in to the platform for a scheduled video consultation, the fee is non-refundable.
  • Cancellations by Practitioner: If a practitioner is unable to attend a scheduled consultation due to unavoidable clinical commitments or emergencies, you will be offered an alternative time slot or a full refund.

5. Privacy and Data Protection

  • Confidentiality: All video consultations are strictly confidential. The platform utilizes secure, encrypted channels to protect your personal and medical data.
  • Data Handling: Your personal health information is processed in compliance with the Personal Data Protection Act, No. 9 of 2022 of Sri Lanka.
  • Recordings: Unauthorized recording, screenshotting, or broadcasting of the video consultation by either the patient or the practitioner is strictly prohibited to protect patient privacy and intellectual property.

6. Limitation of Liability

To the maximum extent permitted by law, DocX.lk and its parent company, directors, employees, and affiliates shall not be liable for any indirect, incidental, or consequential damages resulting from:

  • Misdiagnosis or inappropriate treatment provided by a practitioner utilizing the platform.
  • Delays in receiving medical advice due to technical failures.
  • User failure to provide accurate and complete medical histories.

7. Intellectual Property

All content, software, logos, and designs on DocX.lk are the exclusive property of the platform’s operators. You may not reproduce, distribute, or create derivative works from any part of our platform without explicit written consent.

8. Governing Law and Dispute Resolution

These Terms and Conditions shall be governed by and construed in accordance with the laws of the Democratic Socialist Republic of Sri Lanka. Any disputes arising from or in connection with these terms shall be subject to the exclusive jurisdiction of the courts of Colombo, Sri Lanka.
